MID CONTINENT STEEL & WIRE, INC, by and through its divisions, affiliates, and subsidiaries  (collectively “MCSW”, “we,” “us”, or “our”), informs you of our Privacy Policy (the “Policy”), which describes our practices and the uses of the personal data we collect, use, share, and process, that the users voluntarily communicate via email, telephone or any other electronic, oral or written means with us, fill out forms that collect personal data or access our website and any online platform where this Privacy Policy is posted (the “Sites”). 

By accessing the Sites and communicating information through the means abovementioned, you, as the user, expressly declare to have read, understood, and accepted the information regarding data protection provided by us and, by the same token, expressly consent to the processing of your data for the purposes described below.

I. What personal data do we collect?

For the purpose of this Privacy Policy, Personal Data shall be understood as any information collected concerning identified or identifiable individuals or legal entities; and User, any identified or identifiable individual or legal entity that communicates their Personal Data through the Sites, by any of the following means: (i) e-mail; (ii) filling out forms by which personal data is collected; (iii) participation in campaigns; (iv) creation of User profiles or accounts; (v) use of blogs, chats, forums; (vi) publication of content; and (vii) in general the use of any service present on the website that involves the communication of their personal data.

  1. Information you choose to submit: the Personal Data that we may collect from the Users are: i) full name; ii) address; iii) e-mail; iv) tax ID; v) official ID; and vi) phone number; undertaking that the personal or sensitive information will be treated under security measures.
  • Information we collect automatically: Personal data may be collected indirectly through Cookies, Web Beacons, and/or Pixel Tags, to obtain data on IP addresses, type of browsers, operating systems, web pages visited, duration of browsing time, monitor user behavior and purchase preferences. This information is stored in aggregate form or is anonymous (it is not linked to a specific individual). II. How do we use and share your Personal Data?

MCSW collects and processes the information provided by you as the User to attend to the requests for diverse types of information carried out by them, in connection with the operation of our Sites and potential business relationships.

Your personal data can be also used for the following activities: (i) provision of goods and services related to the steel industry, steel derivatives, and other related industries, (ii) analysis for internal use and preparation of statistical reports, (iii) control of customer, supplier, and service provider files, (iv) marketing, offers and promotions, (v) determining your creditworthiness and if applicable granting credit, (vi) commercial prospecting; (vii) post-sale services related to collection and administration, such as: invoicing cancellations, and delivery arrangements; (viii) knowing the user’s purchase experience through surveys, evaluations or similar; (ix) analysis for internal use of the Corporate office; (x) statistical reports; (xi) human resources planning and file control of internal and/or external personnel, suppliers, collaborators, and any analogous figure; and/or (xii) any other activity related to MCSW ‘s business purpose.

MCSW may transfer the User’s Personal Data to third parties when the disclosure is necessary for the purpose for which the information was obtained as set out in this Policy.

We also may disclose Personal Data where required by applicable law or when the disclosure is necessary for the establishment or maintenance of legal claims or legal compliance, to satisfy any law, regulation, subpoena  or governmental or court order to provide information

Your Personal Data may be transferred to or stored on servers outside of the United States. By using our Sites and or providing information for the purposes of this Policy, you understand that your Personal Data may be transferred to and/or stored in countries outside your country of residence.

If you are located in Mexico, by accessing the Sites or providing Personal Data you agree with and consent to such disclosure to third parties of your Personal Data in accordance with this Policy. With respect to the obligations regarding your Personal Data under this Policy, if we disclose your Personal Data the recipient will receive it under obligations that are not less stringent than the obligations under this Policy.

In the event that we are, or a division or subsidiary is, acquired by, or merged into, another entity, or if there is a sale of all or a portion of our assets, your Personal Data may be transferred to the entity acquiring us, or a division or subsidiary, or into which we are, or a division or subsidiary is, merged or the entity that is purchasing our assets. III. Accessing and updating your information

You can also ask us whether we are keeping information about you and, if so, how it is being used and disclosed, including with respect to disclosures made to third parties outside your jurisdiction of residence. To update your Personal Data, to ask us how we are keeping information about you, or if located in Mexico, to exercise your ARCO rights (by means of which you can access, rectify and cancel your Personal Data, oppose to its processing, limit its use or disclosure, or revoke the consent you have given us for the processing of your Personal Data).

If you are located in Mexico, please include in your privacy request the following information:

  1. Full name of the owner of the personal data.
  2. Address or e-mail address to which all communications related to the request may be sent.
  3. Digitalized copy of an official identity document.
  4. Clear and precise description of the personal data in respect of which you are seeking to exercise any of your rights or the activity for which you wish to limit the use of the personal data.
  • The expressed desire to revoke their consent to the processing of their personal data and therefore for them not to be used; and
  • Any other element that facilitates the location of personal data.

MCSW shall have a period of no more than 20 (twenty) business days to respond to the request by the means indicated by the User. However, if the user considers that their rights with respect to the protection of Personal Data have been violated, has the right to go to the corresponding authority to defend the exercise of their rights.

IV. What security measures do we have to protect your personal data?

The security of your Personal Data is important to us. We protect Personal Data against loss and theft as well as unauthorized access, disclosure, copying, use, and modification using security safeguards, including physical, organization, and technological measures, commensurate with the sensitivity of your Personal Data. Employees who have access to your information are made aware of the importance of keeping it confidential.

Where we use service providers who might have access to your Personal Data, we require them to have privacy and security standards that are comparable to ours. We use contracts and other measures with our service providers to maintain the confidentiality and security of your Personal Data and to prevent it from being used for any other purpose.

V. Do not track disclosures

Given the divergent practices of organizations that offer browsers and the lack of a standard in the marketplace, we do not respond to DNT signals at this time.

VII. About Social Media

MCSW informs the User that it is present in social media, such as Instagram, Facebook, and TikTok. The treatment of the User’s data that become followers of the official sites of MCSW/DEACERO shall be governed by the conditions provided in the terms and conditions of the social network that corresponds since any data that the social network requires to be collected is the responsibility of this social network and not MCSW/DEACERO. Therefore, it is recommended to access the privacy policy and conditions of use of the mentioned websites or, where appropriate, of the social network itself, in order to know the information derived from the treatment of personal data and especially the conditions and purposes for which the data will be used as part of the profile of the User.

VIII. Changes or modifications to this Privacy Policy

MCSW reserves the right to modify this Notice and therefore informs you that any change or modification to the content of this Notice will be published, in a generalized way, on the web page: www.mcswusa.com

IX. Use by minors

We do not intend the Sites and services to be used by individuals under the age of eighteen. We also do not knowingly collect any Personal Data about children under the age of thirteen. If we become aware that we have unknowingly collected Personal Data from a child under the age of thirteen, we will make commercially reasonable efforts to delete such information.
